Tüketici Sözleşmelerindeki Ek Şartlar Meselesinde Haksız Şartlar ve Genel İşlem Şartları

Abstract

Tüketicilerin karşılaştıkları hukukî problemlere hukuk düzeni önem verip çözmeye çalışmaktadır. Tüketicilerin güncel problemlerinden birisi de yaptıkları sözleşmelerde karşılarına çıkan düzenleyen tarafından sözleşmelere koyulan birtakım ek nitelikteki şartlardır. Bu şartlar ile zayıf pozisyondaki tüketicinin daha da zor duruma sokulması ve düzenleyene karşı adalet hislerini rencide edecek şekilde savunmasız bırakılması tehlikesi vardır. Bunu gözeten kanun koyucu Tüketicinin Korunması Hakkındaki Kanununda haksız şart hukukî kurumunu ihdas etmiştir. Bu şartlar hakkında genel koruma sağlayan genel işlem şartları da 6098 sayılı Türk Borçlar Kanununda düzenlenmiştir. Makalede güncel bir tüketici sorunu olan bu şartlara karşı tüketicinin korunması hakkında haksız şart ve genel işlem şartları hukuki kurumlarının özellikleri mukayeseli olarak incelenecektir.

Jurisprudence place emphasis on legal problems and tries to solve them which faced by costumers. One of the current problems of costumers is additional provisions which have put into contracts by the elaborator of contract. With theese provisions there is a possibility of danger that the constumers weak position might change into a worse situation. By this way there is a danger of consumer become vulnerable and this would be opposite to conscience. Legislator take notice of that condition and created unfair term legal notion in the code on the protection of consurmers. Standardized terms of contract legal notion about theese provisions has regulated in Turkish Code of Obligation. The properties of standardized terms of contract and unfair terms legal regulations will be examined in this article by a comparison way to solve consumers current additional provision problem.
