"İnanılır İlgi" Kavramı Çerçevesinde Tapu Sicilinin Bilimsel Çalışmalara Açıklığı

| dc.description.abstract | Özet: Kişilerin eşyalar üzerinde sahip olduğu haklara üçüncü kişiler tarafından saygı duyulabilmesi için bu hakların onlar tarafından bilinebilir hâle getirilmesi gerekir. Türk Hukukunda bu fonksiyonu taşınmazlar için tapu sicili yüklenmektedir. Bu amaç doğrultusunda TMK m. 1020, ilginin inanılır kılınması kaydıyla tapu sicilinin üçüncü kişilere açık olduğu hükmünü içermektedir. Ancak bu ilginin çerçevesinin ne olduğu konusunda Kanun bir belirleme yapmamıştır. Diğer yandan üçüncü kişilerin tapu sicili hakkında bilgi sahibi olma talepleri, mâliklerin özel hayatlarının gizliliği ile çatışabilir. Böyle bir durumda nasıl bir çözüm tarzının benimsenmesi gerektiği tartışmalı bir hâl alabilir. Çalışma kapsamında tapu sicilinin açıklığı ilkesinin çerçevesi incelenmiş ve bilimsel çalışmaların bu çerçevede yer alıp almadığı hususu konu edinilmiştir. Bu doğrultuda mâliklerin özel bilgilerinin tapu sicilinin görülmesine engel olup olmayacağı da temas edilen konular arasındadır. Abstract: The rights that people have on their possessions must be made known by third parties for the respect of this people. In Turkish Law, land register undertakes this function for immovables. In accordance with this purpose, Turkish Civil Law 1020. Clause, contains the rule that the land register is open to third parties provided that making their interest credible. But the law has not made any determination about what the framework of this interest is. Also the request of the third persons to have information about the land register, can conflict with the privacy of the private lives of the wealthy. In such a case, what kind of solution should be adopted can become controversial. In this study, publicity principle of land register and whether or not scientific work takes place in this register was examined. Also, the private information of the property whether or not hinders is are among the topics examined. | en_US |
