Abstract

Sosyal Güvenlik kavramsal içerik olarak, "Çalışanlara belirli sosyal riskler karşısında ekonomik güvence sağlama görevi üstlenen kurumlar topluluğudur" şeklinde tanımlanabilir. Sosyal Güvenlik Sistemlerinin çalışanlara koruma sağladığı risklerden birisi de iş kazasıdır. İş kazası; basit tanımıyla Çalışanın işyerinde, eklentilerinde ve (ya) işi icabı işyeri dışında bulunduğu sırada dıştan gelen bir etkenle aniden meydana gelen bir olay sonucu uğradığı kazadır". Bugüne kadar, iş kazaları ile ilgili birçok çalışma yapılmış ve oldukça geniş bir mevzuat oluşturulmuştur. Buna rağmen iş kazaları istenilen ölçüde önlenememiştir. Bunun birçok nedene bağlamak mümkündür. Ancak en önemlisi; şüphesiz iş kazası olgusu içerisinde yer alan Devlet, işveren ve çalışan unsurlarının sorumluluklarının etkin bir biçimde bilinip uygulanmasındaki aksaklıklar ve bu sorumluluklara çağdaş bir anlayışla yaklaşılamamasıdır. Bu çalışma, iş kazası taraflarının sorumluluklarının neler olduğunun ayrıntılı ve çağdaş bir yaklaşımla belirtilmesini, bu sorumlulukların etkin ve verimli bir biçimde uygulanarak taraflar için iş kazası olaylarının yol açacağı zararları en aza nasıl indirgenebileceğinin yollarını bulmayı hedeflemektedir. Ayrıca, iş kazalarının işletmeler üzerindeki bilinen ve bilinmeyen etkileri irdelenecektir.

Social security, as a conceptual content, is a "the community of the institutes undertaking a mission of providing an economic security fort theemployees againist certain social risks ." For employees, one of the risks againist that Social Security provides a protection is work accidents. Work accident, its additions, and out of workplace as requirement of a job,is an accident that he/she exposes to, through an external impact,as a consequence of an event immediately arises." So far, many studies have been carried out about work accident, and comprehensive. Laws were formed. İn spite of this, the work accidents could not prevent from occurring. It is possible to relate to many reasons. However, the most important ones are the defects in applying of the responsibilities of the governmental officials and authorized members, taking place in the phenomenon of work accidents; of the private sector organizations and that one do not approach contemporarily. This study aims to determine in detail and contemporarily what the responsibilities of the parts of work accident are, and to find the ways about how the harms resulted from work accident will be reduced to minimum for the parts, applying the responsibilities effectively and efficiently. Also, the known and unknown effects of work accidents on businesses will be examined.
