Türk Hukukunda Boşanma Sebepleri ve Kusurun Etkisi

Abstract

Bu çalışmada, başta evlilik ve boşanma kavramları incelenerek, boşanma sebepleri üzerinde durulmuş ve boşanma hukuku üzerinde kusurun etkisine vurgu yapılmıştır. Bu kapsamda başta boşanma sebepleri ve bu sebepler üzerinde kusurun etkisi ile boşanma hukukunun diğer sonuçları üzerinde kusurun etkisi incelenmiştir. Yapılan araştırma ile uygulamada boşanma sebepleri ve boşanmanın diğer sonuçları üzerindeki kusur değerlendirilmesi Kanun lafzından yola çıkarak açığa kavuşturulmuştur. Güncel Yargıtay Kararları da eklenerek kusur oranlarının etkisi daha net bir şekilde ortaya çıkarılmıştır. Türk boşanma hukukunda kusurun değerlendirmesini yaptığımız çalışmamızda evliliğin tanımı, evliliğin sona erme biçimleri, boşanma ve boşanma hukukuna hâkim ilkeler ile boşanma sebepleri üzerinde kusurun etkisi tek tek ele alınmış, boşanmanın diğer sonuçlarına değinilerek Türk Medenî Kanunu çerçevesinde kapsamlı bir kusur incelemesi yapılmıştır. In this study, the concepts of marriage and divorce were examined, the reasons for divorce were emphasized and the effect of the defect on divorce law was emphasized. In this context, the reasons for the divorce and the effect of the defect on these reasons and the effect of the defect on the other consequences of divorce law were examined. In this research, the reasons for divorce and the evaluation of the defect on the other results of the divorce have been clarified based on the Law. The current Supreme Court Decisions have been added to clarify the impact of defect rates. In our study in which we evaluate the defect in Turkish divorce law, the definition of marriage, the types of termination of marriage, the principles prevailing on divorce and divorce law, and the effect of the defect on the reasons for divorce were discussed one by one, and a comprehensive defect examination was conducted within the framework of Turkish Civil Code.
